Contest Rules

These are the rules governing the “Badd Kitty Pet Costume Contest” aired on WMXZ-FM/Mix 95.9FM, 101.7 Chuck-FM/WAVF-FM, Star 99.7 and WXST-FM, 99.3 The Box/WMXZ-HD2 and on the mix959.com, 1017Chuck FM.com, star997.com, and 993thebox.com websites, unless otherwise specified.  Four (4) of the six (6) Charleston Radio Group stations will be participating in this promotion.  Listeners can participate, and win, by listening to any four (4) of those Charleston Radio Group stations.

1. No purchase is necessary to enter this contest.
2. You must be at least 18 years of age to enter this contest.
3. Upload a photo of your pet in their Halloween costume, to the mix959.com, www.1017Chuck FM.com, www.star997.com, or the www.993thebox.com websites between 12:01A on Saturday, October 17, 2020 and 4:59PM on Thursday, October 29, 2020 to be eligible to win.
4. An individual may only enter one pet photo in this contest.
5. All eligible photos will be judged by a panel of 3 pet owning members of the Charleston Radio Group sales staff, none of which have any connection or do business with the contest sponsor(s).   The panel will determine which of the eligible photos submitted, in their opinion, is the cutest in their Halloween costume.   The owner of that pet will be designated as the prize winner.
6. The winner will be contacted by phone and e-mail on Friday, October 30, 2020 beginning at 7AM. In the event there is no response, at least 3 additional attempts to contact the winner will be made that day, and again on Monday, November 2, 2020.
7. The winner will receive $250 dollars in cash, in the form of a $250 check made out to the winner, courtesy of Badd Kitty, 2274 Savannah Highway, Charleston SC, plus, a Badd Kitty gift basket, valued at $100. The total value of the prize package will be $350.00.
8. Images submitted must be owned by the person submitting the entry. No one else may have, or can claim, legal rights to the image. If there is a “minor” (a child or person under the age of 18) in this image, the entrant must certify that he or she is the parent or legal guardian of the minor (child or children) in the image. Any misrepresentation of ownership of the submitted image, or legal guardianship of the minor in the submitted image (if any), will be grounds for disqualification of the contest and potentially all future contests or promotions with Charleston Radio Group. Entries containing inappropriate images will be disqualified. Charleston Radio Group has final say of what content is appropriate for the website and has absolute discretion over the eligibility of an image entry. No indecent or obscene material, no content or material that is illegal, no material containing nudity or is sexually explicit, or by law, obscene profane or pornographic is permitted. By entering this contest, you are verifying that you are the owner and producer of the submitted material and that no third-party ownership rights exist to the image. If the image contains people, by submitting such image you agree to have the rights necessary to consent or submit on behalf of those in the image.
9. Anytime you call the 101.7 Chuck FM studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record it for later broadcast.
10. As a winner of a 101.7 Chuck FM contest your voice, name and/or picture may be used for promotional, broadcast, or internet purposes without any compensation to you.
11. Prizes awarded are not redeemable for cash. No prize is transferable. No substitution for a prize will be made at the request of winner. 101.7 Chuck FM reserves the right to substitute a prize of similar value.
12. 101.7 Chuck FM’s sole responsibility will be to award the prize. 101.7 Chuck FM will have no further responsibility in connection with the prize if the prize winner, for any reason, cannot or decides not to use any of the prize.
13. All winners of all contests are responsible for all taxes on prize awarded. All winners of a prize valued at $600 or more will be required to complete the appropriate tax forms at the 101.7 Chuck FM studios prior to claiming prize. All winners will be sent a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won exceeds $600.
14. In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), 101.7 Chuck FM’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as (101.7 Chuck FM) awarding the prize to the winner. 101.7 Chuck FM shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. 101.7 Chuck FM shall not be liable for any claim by any winner for damages incidental thereto.
15. All 101.7 Chuck FM contests are open to all eligible residents 18 or over (unless otherwise specified) living within 75 miles of station transmitter(s). Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to 101.7 Chuck FM that will be presented to 101.7 Chuck FM and accepted before the prize is awarded. Employees of 101.7 Chuck FM, it’s advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one-hundred mile radius of the 101.7 Chuck FM main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. 16. Winners will be expected to claim prize at the 101.7 Chuck FM studios, 2294 Clements Ferry Rd. Charleston, SC 29492, between 9:00am – 5:00pm, Monday through Friday (excluding holidays) within 30 days of being notified that they are winners, unless there is an expiration date on prize, which will be specifically stated.
17. All federal, state, and local laws and regulations apply. Contest is void where prohibited.
18. 101.7 Chuck FM reserves the right to disqualify any entrant if any contest rules are violated in any way.
19. 101.7 Chuck FM assumes no liability for situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. 101.7 Chuck FM, its advertising agencies, affiliates, contest sponsors, employees, and immediate families of each are absolved and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.
20. As a licensee of the FCC and a trustee of the public airwaves, 101.7 Chuck FM reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of 101.7 Chuck FM management if world events, the national mood, or public safety so warrant.
21. 101.7 Chuck FM reserves the right to amend the rules to any contest at any time. 101.7 Chuck FM’s decision is always final. In the event any one of the general contest rules which govern all 101.7 Chuck FM contests contradict with any specific contest term, the specific contest term will control.
22. For any contest requiring phone entry you must use only the following number unless otherwise specified: 843-721-1017. For texting it is 77000. The person operating the telephone at 101.7 Chuck FM has the final decision as to who is the winning caller.
23. 101.7 Chuck FM shall have no responsibility for contestant’s inability or failure to participate, failure to win or claim any prize based on malfunction or difficulties with telephone, cell phone, texting, email, or internet access, or any other circumstances in any contest beyond 101.7 Chuck FM’s control.
24. For any contest involving on-line voting: If an entrant receives irregular votes, including but not limited to, votes generated by a robotic, programmed, script, macro, or other automated means, 101.7 Chuck FM reserves the right to disqualify the entrant in its sole discretion and/or use another means to determine the winner(s), ex. – random selection or appointing a panel of judges.
25. 101.7 Chuck FM is not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or act of man or God, lost, late, misdirected, postage-due, unintelligible, returned, undelivered entries or email, or lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic, or network. Persons who tamper with or abuse any aspect of this contest or website, or act in violation of the official service, as solely determined by the station, will be disqualified. Neither sponsor nor promotion parties are responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this contest, and assumes no responsibility for any errors, omissions, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. 101.7 Chuck FM is not responsible for injury or damage to participant’s or any other person’s computer or property related to or resulting from participating in this contest. Should any portion of contest be, in 101.7 Chuck FM’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the station, corrupt or impair administration, security, fairness or proper play of this contest, or contest plays, 101.7 Chuck FM reserves the right at its sole discretion to suspend, modify or terminate the contest.
26. 101.7 Chuck FM has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on prize (if any) are provided only by the manufacturer, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
