Contest Rules:

These are the rules governing the “Carolina Spa Company Valentine’s Day Hot Tub Giveaway” contest aired on WMXZ-FM/Mix 95.9FM, WCKN-FM/92.5 Kickin’ Country/, 101.7 Chuck-FM/WAVF-FM, and Star 99.7, WXST-FM, radio and on the mix959.com, 925kickincountry.com, 1017chuckfm.com, and star997.com websites, unless otherwise specified.  All Charleston Radio Group stations will be participating in this promotion.  Listeners can participate, and win, by listening to any of the Charleston Radio Group stations:

1. No purchase is necessary to enter any 101.7 Chuck-FM contest.
2. You must be at least 21 years of age, a legal resident of South Carolina and have a valid South Carolina driver’s license to enter and win.
3. Beginning Monday, January 15, 2024 at 8:00AM and continuing each Monday through Thursday, through Tuesday, February 13, 2024 at 11:59PM, individuals will be able to listen to any of these four (4) Charleston Radio Group radio stations – WMXZ-FM, Mix 95.9, WXST-FM, Star 99.7, WCKN-FM, 92.5 Kickin Country, and WAVF-FM, 101.7 Chuck-FM – to win.
4. Listeners will be competing with other listeners from all four (4) of these Charleston Radio Group stations for the same prize.
5. Individuals that are employees or affiliates of the Carolina Spa Company, 6185 Rivers Ave-Suite O, North Charleston, SC 29406 are not eligible to enter and/or win.
6. Each Monday through Thursday during the contest period, at approximately 8AM, 11AM, 1PM, 3PM and 5PM, each station will announce a winning keyword.   Listeners can text that word to 43414 as many times as they wish to be entered to win a weekly prize and entered to win the Valentine’s Day Hot Tub Giveaway grand prize. Standard text and data charges may be applied.
7. An individual may also receive a bonus entry in the contest by visiting a website through a link received in a bounce back message the first time the individual texts a winning word.   The individual will be asked to provide additional information to receive the bonus entry.  The bonus entry is optional.
8. Each Friday morning during the contesting period, January 19, 2024 through February 9, 2024, at approximately 9AM, one (1) winner will be selected in a random drawing from all eligible text entries to win a weekly prize.  Eligible text entries will be texts received between 8AM the Monday before that Friday, and 11:59PM on the Thursday before the Friday morning drawing.

1. That winner will be contacted immediately after being selected as the winner.   At least three (3) attempts will be made to contact that person by phone and/or text at the number the text was received from within 2 hours of being selected.  The winner will have 2 hours to respond.   If the winner does not respond, another winner will be randomly selected from all remaining eligible entries.
2. An individual may only win one (1) weekly prize during the contest.
3. Winning a weekly prize does not eliminate an individual from winning the contest grand prize.
4. The winner will be required to claim their weekly prize at the Charleston Radio Group, 2294 Clements Ferry Road, Charleston, SC 29492 during regular business hours within 30 days.

14. On Wednesday, February 14, 2024 at approximately 9AM, one (1) winner will be selected in a random drawing from all eligible text entries to win the Valentine’s Hot Tub Giveaway grand prize. The grand prize is a Nordic Crown XL Hot Tub – Drift/Cedar/Stainless Steel Banding/Mood Lighting Package/Ozonator/Black Cover/Black Steps from the Carolina Spa Company, 6185 Rivers Ave-Suite O, North Charleston, SC 29406, valued at $11,074.00.  In addition to the Hot Tub, the prize includes a Cover, Cover Lifting System, Steps, First Months Chemical Kit, Delivery and Installation.     Hot Tub does not include the required 240V/50Amp service or any Hardscaping needs.
15. At least three (3) attempts will be made to contact that person by phone and/or text at the number the text was received from within 2 hours of being selected. The winner will have 2 hours to respond. If the winner does not respond, another winner will be selected in a random drawing of all remaining eligible entries.
16. The winner of the Valentine’s Day Hot Tub Giveaway Grand Prize is required to own their home. If HOA/ARB approval is needed, the winner needs to acquire this approval.
17. The grand prize is not transferable and cannot be redeemed for cash.
18. After being determined the winner, that individual will have seven (7) business days to visit Carolina Spa Company, 6185 Rivers Ave-Suite O, North Charleston, SC 29406 to sign all appropriate paperwork, claim their hot tub and make arrangements for delivery and installation.
19. The winner is responsible for any and all local, state and/or federal taxes and will need to fill out a 1099 tax form provided by the Carolina Spa Company.
20. To be eligible to win any prize on 101.7 ChuckFM you must not have won anything on 101.7 ChuckFM in the past 30 days or any prize valued at $600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.
21. Anytime you call the 101.7 ChuckFM studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record it for later broadcast.
22. As a winner of a 101.7 ChuckFM contest your voice, name and/or picture may be used for promotional, broadcast, or internet purposes without any compensation to you.
23. No prize is transferable. No substitution for a prize will be made at the request of winner. 101.7 ChuckFM reserves the right to substitute a prize of similar value.

1. 101.7 ChuckFM’s sole responsibility will be to award the prize. 101.7 ChuckFM will have no further responsibility in connection with the prize if the prize winner, for any reason, cannot or decides not to use any of the prize.

25. All winners of all contests are responsible for all taxes on prize awarded. All winners of a prize valued at $600 or more will be required to complete the appropriate tax forms at the 101.7 ChuckFM studios prior to claiming prize. All winners will be sent a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won exceeds $600.
26. In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), 101.7 ChuckFM’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as (101.7 ChuckFM) awarding the prize to the winner. 101.7 ChuckFM shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. 101.7 ChuckFM shall not be liable for any claim by any winner for damages incidental thereto.

1. All 101.7 ChuckFM contests are open to all eligible residents 18 or over (unless otherwise specified) living within 75 miles of station transmitter(s). Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to 101.7 ChuckFM that will be presented to 101.7 ChuckFM and accepted before the prize is awarded. Employees of 101.7 ChuckFM, it’s advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one-hundred mile radius of the 101.7 ChuckFM main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. 28. All federal, state, and local laws and regulations apply. Contest is void where prohibited.
29. 7 ChuckFM reserves the right to disqualify any entrant if any contest rules are violated in any way.
30. 7 ChuckFM assumes no liability for situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. 101.7 ChuckFM, its advertising agencies, affiliates, contest sponsors, employees, and immediate families of each are absolved and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.
31. As a licensee of the FCC and a trustee of the public airwaves, 101.7 ChuckFM reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of 101.7 ChuckFM management if world events, the national mood, or public safety so warrant.
32. 7 ChuckFM reserves the right to amend the rules to any contest at any time. 101.7 ChuckFM’s decision is always final. In the event any one of the general contest rules which govern all 101.7 ChuckFM contests contradict with any specific contest term, the specific contest term will control.
33. For any contest requiring phone entry you must use only the following number unless otherwise specified: 843-721-1017. For texting it is 77000. The person operating the telephone at 101.7 ChuckFM has the final decision as to who is the winning caller.
34. 7 ChuckFM shall have no responsibility for contestant’s inability or failure to participate, failure to win or claim any prize based on malfunction or difficulties with telephone, cell phone, texting, email, or internet access, or any other circumstances in any contest beyond 101.7 ChuckFM’s control.
35. For any contest involving on-line voting: If an entrant receives irregular votes, including but not limited to, votes generated by a robotic, programmed, script, macro, or other automated means, 101.7 ChuckFM reserves the right to disqualify the entrant in its sole discretion and/or use another means to determine the winner(s), ex. – random selection or appointing a panel of judges.
36. 7 ChuckFM is not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or act of man or God, lost, late, misdirected, postage-due, unintelligible, returned, undelivered entries or email, or lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic, or network. Persons who tamper with or abuse any aspect of this contest or website, or act in violation of the official service, as solely determined by the station, will be disqualified. Neither sponsor nor promotion parties are responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this contest, and assumes no responsibility for any errors, omissions, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. 101.7 ChuckFM is not responsible for injury or damage to participant’s or any other person’s computer or property related to or resulting from participating in this contest. Should any portion of contest be, in 101.7 ChuckFM’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the station, corrupt or impair administration, security, fairness or proper play of this contest, or contest plays, 101.7 ChuckFM reserves the right at its sole discretion to suspend, modify or terminate the contest.
37. 7 ChuckFM has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on prize (if any) are provided only by the manufacturer, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
38. The following are specifically related to E-contests and E-Mail Club promotions on 1017chuckfm.com:
    1. All appropriate information in required fields must be entered correctly and completely or you will be disqualified.
    2. To win a prize you must reside within the listening area of 101.7 ChuckFM as defined at the exclusive discretion of 101.7 ChuckFM management.
    3. Any problems with the internet or email are not 101.7 ChuckFM’s responsibility.
    4. Contestants who register to participate on our website may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.
    5. Due to the nature of our programs that are heard on-line over the internet, contests may not be heard at all on 101.7 ChuckFM. Contests heard on the radio station’s internet audio stream may be slightly delayed from the time the contests are heard on the broadcast station, and will be running behind the broadcast signal. Thus, all contests heard on the internet are delayed. This delay can last for as much as 30 seconds or more. This means that when 101.7 ChuckFM contests are played that require a specific caller to telephone the radio station (such as “Caller number 9 when you hear the sound effect”), listeners to the on-line audio stream may be at a disadvantage in participating over those listeners who hear the contests on-air.
